These General Terms and Conditions govern the contractual relationship between Nauticaravaning and the customer renting one of its motorhomes.<\/p>\n
The rental includes the temporary transfer of use of the selected vehicle for the contracted period, in accordance with the conditions established in the rental agreement and in this document.<\/p>\n
Nauticaravaning’s objective is to offer a safe, comfortable and high-quality travel experience, ensuring that each customer receives a properly prepared, inspected and equipped vehicle.<\/p>\n
Acceptance of the reservation and signing of the rental agreement imply full acceptance of these General Terms and Conditions, as well as of the condition of the vehicle, accessories and inventory provided.<\/p>\n
In order to rent and drive a Nauticaravaning vehicle, the following requirements must be met:<\/p>\n
All drivers must meet these requirements and provide the necessary documentation before the vehicle is handed over.<\/p>\n
Nauticaravaning may request additional information when necessary to verify the driver’s identity or requirements.<\/p>\n
The vehicle may only be driven by persons expressly authorised in the rental agreement.<\/p>\n
A reservation request does not imply automatic confirmation of the rental.<\/p>\n
The reservation will be confirmed when:<\/p>\n
Until that time, Nauticaravaning does not guarantee vehicle availability for the requested dates.<\/p>\n
Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n Once the reservation has been confirmed, the customer accepts these General Rental Terms and Conditions.<\/p>\n The total rental amount must be paid before the vehicle is handed over, unless Nauticaravaning has expressly agreed to another payment arrangement.<\/p>\n Payment may be made using the payment methods accepted by Nauticaravaning.<\/p>\n Vehicle handover is subject to compliance with the established financial obligations.<\/p>\n If there are any outstanding amounts, Nauticaravaning may refuse to hand over the vehicle until they have been settled.<\/p>\n In the event of cancellation by the customer, the following conditions shall apply:<\/p>\n Cancellations more than 45 days before the start of the rental<\/strong> Cancellations between 30 and 45 days before the start of the rental<\/strong> Cancellations between 15 and 30 days before the start of the rental<\/strong> Cancellations less than 15 days before the start of the rental<\/strong> If the customer fails to appear on the agreed date and time for vehicle collection without prior notice, the reservation will be considered cancelled by the customer and the amount paid will be forfeited.<\/p>\n In duly justified exceptional circumstances, Nauticaravaning may assess each case individually.<\/p>\n If Nauticaravaning manages to re-rent the vehicle for the same dates originally reserved, it may consider an additional refund, deducting the administrative and management costs incurred.<\/p>\n At the time of vehicle handover, the customer must provide a \u20ac1,000 security guarantee by bank card.<\/p>\n The purpose of this guarantee is to cover any liabilities arising from the rental, including:<\/p>\n For rentals of less than 5 days, Nauticaravaning may make a bank pre-authorisation for an amount of \u20ac1,000.<\/p>\n This operation involves a temporary hold of the amount on the customer’s card, without an actual charge being made. The amount will be released once the vehicle has been inspected and it has been verified that there are no outstanding incidents.<\/p>\n For rentals of 5 days or more, Nauticaravaning may charge the \u20ac1,000 security guarantee.<\/p>\n Once the vehicle has been inspected:<\/p>\n The security guarantee will be refunded within a maximum period of 3 working days after the vehicle has been returned, provided there are no incidents pending assessment.<\/p>\n Where damage cannot be assessed immediately, Nauticaravaning may retain all or part of the security guarantee until the relevant assessment, quotation or invoice is available.<\/p>\n Nauticaravaning will hand over the vehicle:<\/p>\n Before the rental begins, an explanation will be provided regarding the general operation of the vehicle and its main components.<\/p>\n The customer must inspect the vehicle, accessories and inventory before starting the journey.<\/p>\n Any observations must be communicated before departure.<\/p>\n Signing the handover document constitutes acceptance of the condition of the vehicle received.<\/p>\n The customer must return the vehicle:<\/p>\n Late return of the vehicle without prior authorisation may result in additional charges.<\/p>\n If the vehicle is returned in conditions different from those agreed, Nauticaravaning may charge the costs necessary for cleaning, replenishment or the required conditioning work.<\/p>\n All Nauticaravaning vehicles have the compulsory insurance and the cover contracted under the policy in force at the time of the rental.<\/p>\n The customer acknowledges that the vehicle has an insurance excess of \u20ac1,000, this being the maximum financial liability of the customer in claims covered by the insurance policy and provided that there is no cause for exclusion of coverage.<\/p>\n The customer’s liability will be limited to this excess when:<\/p>\n Insurance coverage is subject to compliance with:<\/p>\n Damage resulting from incorrect, negligent or non-compliant use of the vehicle will not be covered.<\/p>\n Among other circumstances, the following may be excluded:<\/p>\n In such cases, the customer may be liable for the full amount of the damage caused.<\/p>\n In the event of an accident, breakdown or any incident during the rental period, the customer must act responsibly and follow these instructions:<\/p>\n In emergency situations where action is necessary to ensure people’s safety or prevent further damage, the customer must inform Nauticaravaning as soon as possible.<\/p>\n In the event of an accident involving third parties:<\/p>\n Failure to immediately report an incident may result in liability for the customer where such failure causes loss to Nauticaravaning or makes insurance management more difficult.<\/p>\n The vehicle must be used exclusively for tourism and leisure purposes.<\/p>\n The customer undertakes to use it with the diligence expected of a responsible user and driver.<\/p>\n During the rental, the customer must:<\/p>\n The customer shall be responsible for the consequences arising from incorrect use of the vehicle.<\/p>\n Only persons expressly included in the rental agreement may drive the vehicle.<\/p>\n Nauticaravaning allows one additional driver to be included free of charge, provided that they meet the same requirements established for the main driver:<\/p>\n Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n The customer shall be responsible for any damage or loss caused when the vehicle is driven by an unauthorised person.<\/p>\n In order to guarantee the safety of the vehicle and its occupants, the following are expressly prohibited:<\/p>\n Failure to comply with these prohibitions may result in termination of the contract and a claim for any damage caused.<\/p>\n The customer shall be responsible for damage caused to the vehicle when such damage results from incorrect, negligent or non-compliant use.<\/p>\n Damage caused by the following is considered particularly relevant:<\/p>\n The customer declares that they are aware of the vehicle’s dimensions and shall be responsible for damage caused by collisions with:<\/p>\n The customer shall be responsible for damage caused by:<\/p>\n Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n The customer may also be responsible for:<\/p>\n The vehicle’s exterior elements require careful use due to their sensitivity and repair costs.<\/p>\n The customer must:<\/p>\n Damage caused by incorrect use of the awning or exterior elements may be considered the result of negligence and may fall outside insurance coverage.<\/p>\n Nauticaravaning allows travel within Europe provided that the countries are included in the coverage of the insurance policy in force.<\/p>\n The customer must inform Nauticaravaning before the rental begins of the countries they intend to visit.<\/p>\n Travel is authorised in:<\/p>\n Nauticaravaning may restrict certain destinations where there are insurance restrictions, exceptional circumstances or situations that could compromise vehicle safety.<\/p>\n At Nauticaravaning we are pet-friendly.<\/p>\n Pets may travel under the following conditions:<\/p>\n Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n To ensure that each customer receives the vehicle in perfect condition, an \u20ac80 surcharge will apply for deep cleaning and sanitisation after the rental.<\/p>\n Damage caused by the pet, including defects, stains, odours or damage to the furniture, may be charged to the customer.<\/p>\n The customer shall be responsible for all fines, penalties, tolls, fees, regulated parking charges or expenses arising from the use of the vehicle during the rental period.<\/p>\n If Nauticaravaning receives an administrative notification relating to the rental period, the company may identify the responsible driver to the competent authority.<\/p>\n When administrative procedures relating to fines, penalties or claims are required, Nauticaravaning may apply an administrative fee of \u20ac25 per case, in addition to the corresponding penalty amount.<\/p>\n This amount relates exclusively to the time and administrative management carried out by Nauticaravaning.<\/p>\n The rental includes the mileage established in the rate or rental package contracted by the customer.<\/p>\n The customer may check the applicable mileage conditions before formalising the reservation.<\/p>\n Kilometres driven above the contracted limit will incur an additional charge of:<\/p>\n \u20ac0.30\/km<\/strong><\/p>\n The amount corresponding to additional kilometres may be deducted from the security guarantee or invoiced subsequently to the customer.<\/p>\n The customer shall be responsible for monitoring the mileage driven during the rental period.<\/p>\n The vehicle will be delivered with:<\/p>\n The customer must return the vehicle in the same condition.<\/p>\n Otherwise, Nauticaravaning may charge the costs necessary to replenish these items.<\/p>\n The customer shall be responsible for using the correct fuel for the vehicle.<\/p>\n Refuelling with incorrect fuel will be considered negligent use and all resulting damage may be charged to the customer.<\/p>\n Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n At Nauticaravaning, we prepare each vehicle so that every customer can start their journey in the best possible conditions.<\/p>\n The vehicle must be returned in an appropriate state of cleanliness, taking into account normal use during a rental.<\/p>\n Normal dirt resulting from responsible use is not considered extraordinary cleaning.<\/p>\n Additional charges may apply when special cleaning work is required due to:<\/p>\n The amounts indicated are for guidance and may vary depending on the actual condition of the vehicle and the work required to return it to its original condition.<\/p>\n The customer must respect the agreed vehicle collection and return times.<\/p>\n These times allow Nauticaravaning to properly carry out inspection, cleaning and preparation work for subsequent rentals.<\/p>\n In the event of unreported delays or returns outside the established schedule, Nauticaravaning may apply additional charges when such delay generates costs, causes losses or affects a new reservation.<\/p>\n If the customer needs to change the scheduled time, they must inform Nauticaravaning in advance so that availability can be assessed.<\/p>\n In order to guarantee transparency for both Nauticaravaning and the customer, the company may take photographs or videos of the vehicle’s condition at the time of handover and return.<\/p>\n Nauticaravaning \u00b7 General Rental Terms and Conditions<\/strong><\/p>\n This record may include:<\/p>\n The images may be used exclusively as evidence in the event of discrepancies relating to the condition of the vehicle, damage or incidents arising from the rental.<\/p>\n The personal data provided by the customer will be processed by Nauticaravaning in accordance with the applicable data protection regulations.<\/p>\n The information will be used to:<\/p>\n The customer may exercise their rights of access, rectification, erasure, objection, restriction and portability in accordance with applicable legislation.<\/p>\n For further information regarding the processing of personal data, the customer may consult Nauticaravaning’s privacy policy.<\/p>\n These General Terms and Conditions shall be governed by the applicable Spanish legislation.<\/p>\n The parties undertake to attempt to resolve amicably any dispute that may arise during the contractual relationship.<\/p>\n If no agreement can be reached, the courts and tribunals with jurisdiction under applicable legislation shall have jurisdiction.<\/p>\n Signing the rental agreement means that the customer:<\/p>\n The
